This document sets out stefanoconti.it general terms and conditions of sale.

DEFINITIONS

To enable full understanding and acceptance of these terms and conditions, the following singolar and plural terms shall have the meanings set forth below:

User: anyone who accesses and uses the Application.
Consumer User: a person of full age who concludes a contract for purposes unrelated to his business, commercial, handicraft or professional activity.
Conditions: this contract that governs relations between Owner and Users, as well as the sale or supply of SC CAMICERIA Srl products through the Application.

GENERAL INFO

These General Conditions of Sale relate to the purchase of products directly from the website stefanoconti.it, belonging to SC CAMICERIA Srl, with registered office in via M.Buonarroti nr 1, 25010, San Zeno Naviglio (BS). Each purchase transaction will be governed by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information for the conclusion of the contract will be submitted to the art. 12 of Legislative Decree 70/03 and, as far as the protection of personal data is concerned, to the provisions of Legislative Decree 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

Product sales agreement shall be considered concluded when the purchase order is received and accepted by the customer. SC CAMICERCIA will promptly send the customer the purchase order receipt.
The customer, by submitting his purchase order, declares to have read and to integrally accept the general terms and conditions. He also undertakes to observe and comply with them in his dealings with our company.

PERSONAL DATA PROCESSING

SC CAMICERIA Srl informs you that, pursuant to art. 13 of Legislative Decree 196/2003, personal and fiscal data acquired also verbally with reference to established business relationship, directly provided by the interested parties, or otherwise acquired as part of the company’s activities, will be processed in compliance with the afore-mentioned regulation, including confidentiality obligations provided for therein. In relation to the aforementioned obligations, you may exercise your rights under art. 7 of Legislative Decree 196/2003.

CUSTOMER’S OBLIGATIONS

Before submitting his purchase order, the customer has to read these general conditions of sale carefully. Submitting the purchase order implies global knowledge as well as integral acceptation thereof.
Lastly, once the on-line purchase procedure has been concluded, the customer agrees to print and save a copy of these general conditions of sale, already read and accepted.

DEFINITION OF THE ORDER

By placing an order, the customer sends to SC CAMICERIA Srl a proposal to purchase the product or products selected. When the customer places an order online for the products selected, he agrees to purchase at the price and terms set out in these general conditions of sale.

SC CAMICERIA Srl informs the customer acceptance and confirmation of his order.
SC CAMICERIA Srl will not accept orders:
If the material, at the time of ordering, is no longer available and/or
If the customer cannot or will not pay using credit cards (Paypal), bank transfer, or cash on delivery.

It is possible to place an order either through the stefanoconti.it website, at the prices and conditions indicated therein, or from authorised retailers.

HOW TO PURCHASE

The customer buys the product, whose main features are displayed on-line in its relative descriptive and technical pages, at the price indicated plus the delivery costs specified on the website (any costs for cash on delivery payment are excluded).
Before the purchase order is placed, the customer will be shown the cost per unit of each selected product, the total cost in the event of purchasing more than one product as well as the relevant transportation costs.
Once the purchase order has been submitted, the customer receives an e-mail from SC CAMICERIA Srl confirming receipt of the purchase order and containing information related to the product’s main features, a detailed indication of its price, delivery costs, applicable taxes and means of payment and containing a reference to the general conditions of contract as well as information about the right of withdrawal, its conditions and how to exercise it.
Following the approval of Decree Law No. 223 of 4 July 2006 “manovra bis” art. 37, paragraphs 8 and 9, converted into Law 248 of 4 August 2006, came into effect on 12 August 2006, by which the obligation to communicate the list of customers and suppliers when issuing an invoice is restored, and Decree Law No. 78 of 31 May 2010, converted into law 122 of 30 July 2010, requires customers to communicate their VAT number and tax code in the appropriate fields on the website.

PAYMENT

The customer can make the payment by choosing one of the following methods:
Pay by credit card: if the consumer intends to pay by credit card, he may use the Paypal payment procedure, which is suitable for ensuring the customer’s data confidentiality. For any information and further Legal Agreements, the customer can refer to the www.paypal.com website.
Pay by bank transfer: it can be made using the form in Checkout during the purchase procedure.
If payment is made by bank transfer, the purchased product will be shipped as indicated in the following paragraph “Delivery of the products”, to the address specified by the customer upon receipt of the credit note, so usually within two/five days after the transfer has been made (the timing varies depending on the bank used). To facilitate the process, the payment receipt can be sent together with your order number to the following email address: info@stefanoconti.it

DELIVERY OF THE PRODUCTS

The purchased product is delivered by courier to the address specified by the customer at the time of the on-line order. Any specific requirement shall be communicated to SC CAMICERIA Srl by the customer himself.
SC CAMICERIA Srl guarantees the delivery of the product within 15 (fifteen) working days from the date of receipt of the transaction.
In case the customer or the person authorized to receive the products is absent, the courier will try another time. If the customer is still absent, the goods will be kept at the courier’s headquarters for a while and then being returned to sender.

GUARANTEE OF COMPLIANCE AND DEFECTIVE PRODUCTS

The products purchased on our website are subject to the discipline on the sale of consumer goods. The delivered products shall comply with the key features illustrated in the descriptive and technical online sheets.
SC CAMICERIA Srl is liable to the customer for any lack of conformity existing at the time of delivery.

RIGHT OF WITHDRAWAL

The costumer has the right to exercise his right of withdrawal. In particular, the costumer has the right to withdraw from any contract with SC CAMICERIA Srl within 14 days from receiving the goods, without any penalty and without specifying the reason. This right is lost in case of customized or tailor-made products.
Costumers are entitled to exercise their right of withdrawal in relation to any goods bought on stefanoconti.it website.

HOW TO EXERCISE THE RIGHT OF WITHDRAWAL

The right of withdrawal is exercised by sending, within that timeframe, a written communication to SC CAMICERIA Srl by registered letter with advice of delivery or PEC to sccamiceria@pec.it.
The notification of withdrawal may also be sent, within the same timeframe, by email (assistenza@stefanoconti.it) or by fax, provided that it is confirmed with registered letter with return receipt within 48 hours.
If the customer exercise his right of withdrawal, the communication should be made to the following address:

If the products have already been delivered, the costumer must send them back to SC CAMICERIA Srl within 15 (fifteen) working days from the delivery date.
The returned product must be complete of all accessories, from original packaging to attached documents and everything else.
A copy of the electronic order receipt must be attached to the returned product. The fees for returning purchased products to SC CAMICERCIA Srl are at the customer’s expense. If the right of withdrawal is exercised by the customer in accordance with the provisions laid down in this clause, SC CAMICERIA Srl is required to refund the price paid by the costumer.
SC CAMICERIA will proceed free of charge to the transmission of the re-credit order for the cost of the product shipped, including shipping costs within 30 (thirty) days from the date on which it became aware of the customer’s exercise of his right of withdrawal. This transaction will be carried out through the banking institution that issued the credit card used for payment or by crediting the bank current account specified by the customer.
SC CAMICERIA Srl has the right to reject any product returned by methods other than those specified above, as well as products for which the costumer has not fully paid the return costs, or has not complied with the procedures and time limits specified for communicating the exercise of the right of withdrawal.

XPRESS TERMINATION CLAUSE

Pursuant to and for the purposes of art. 1456 of the Civil Code, in case of total or partial non-payment of the purchased products, SC CAMICERIA Srl reserves the right to declare the termination of the contract by sending a written notice to the customer’s e-mail address.

COMPLAINTS

For any complaint or clarification, the customer must contact the following e-mail address assistenza@stefanoconti.it providing personal details, a preferential channel for being contacted, the details of the order in dispute, complaint or clarification. The customer will be contacted within 3 (three) working days of the request.

APPLICABLE LAW AND JURISDICTION

This contract is governed by Italian law. The jurisdiction for any legal action brought by the purchaser under this warranty or any additional legal guarantees shall be the Court.
Should SC CAMICERIA Srl win in any legal action, the plaintiff shall reimburse SC CAMICERIA Srl for all expenses, including lawyers’ fees and costs of the proceedings, incurred by SC CAMICERIA Srl for its own defence.

REFERENCE

For anything not expressly covered by this contract, the provisions of current italian law shall apply.
